I would hope Mike cares about the fans enough to back up what he said if it came down to it. That you could show his post on the LP.com forums and wherever else he said it and he would admit he said that. Now who knows if that would even help but it's a chance.

People got to stop saying.. "mike said it was ok". "He need to back up the fans".

 

No he don´t. If there was any illegal material on the site Warner has the right to sue the one who was providing it.

 

And by the way...Mike says all the time in his site/blog. When you sign a contract you need to know you are under rules of the record label, and these are the Warner rules. Don´t share official Linkin Park material. Period.

 

I didn´t saw the site. I´m just assuming there was official material in there. If there wasn´t nobody should be worried because the guy would win in the court.

Well, I think Mike cares a lot about the fans. But I really doubt Mike can help. If there is a chance to kick warners ass.....Mike would do that already. Just read between the lines on his blog... ;)

 

But what would happen if Mike stands really up against Warner?

Warner: "Oh, you don't like what we do? Well, you can go! But everything what ever you have written, recorded...all in your mind....IT'S MINE!"

 

I hope everything will go well for the italian guy.

I believe by "no copyright infringement" he means no copyright infringement from Warner Brothers, who definitely have jurisdiction over all their recorded releases. Otherwise the copyright goes to Linkin Park, theoretically. The only defense, and I am no lawyer, I can think of is to say Warner is not the copyright holders of these performances and cannot sue him. Linkin Park must be the ones to file the lawsuit. I think that's kinda taunting the bull here, but it might reduce the number of songs he might have to pay for, and I doubt LP would attempt to sue...

 

I don't think the LP.com archives go far enough back, but I recall distinctly in December 2002 a post by Mike Shinoda on the news page, right after LPU 1.0 ended, saying that if fans cannot get a hold of the HTEP, then they can download it. His post was followed by a track listing of the CD. This is one reason why I don't think LP would be inclined to sue.

 

Where it might get foggy, imo, is those internal Warner demos. They might or might not count. I don't know what was hosted on LPI but those demos might have been there. And of course, I cannot tell the exact details of LP and Warner's contract, and so I cannot tell how much power Warner had over LP's works. Or whether or not LP have any copyright power over their songs.

 

I think it's woth considering. Then again, i wrote it.

 

 

 

You guys are acting like Warner is just making this up for the fuck of it. They violated some copyright law and will go in front of a judge. If there's no case then they won't win BUT if the guy is guilty he'll be found guilty and punished. Warner is a BUSINESS. You guys always forget that. They're not out here to make friends, they're here to make money and they do a damn good job of it.

In copyright lawsuits, you are guilty until proven innocent. That isn't what it says on paper but it how it typically goes down in court.

I think whitout documents, say "Mike said it's okay" doesn't have so much value in court.

You got something better than a handshake deal though. What Mike Shinoda said is in print. January 2007. I can still remember when he said it.

 

I don't think he would say that unless that were something outside of Warner's reach, I could be wrong though.

And true, we can't keep saying that Mike said it was okay to (and I quote) "Torrent away!". Warner owns Mikes ass, not the other way around. They pretty much have the power to override what he says about anything that has to do with their material.

 

Is there anyway that LP could get out of Warner's contract and Start their own label?

I don't know what linkin-park.it had in their download, but if it really was stuff like demos and instrumentals I don't get it.

Nameless - how was it - Warner warned him, he deleted the files and after that Warner wants to punish him?

It makes me wonder though, Linkin Park are one of Warners biggest and most consistent band signed, Warner where probably on there knees the in 2005 when LP wanted out.

 

To me it seems that theres been some serious meetings up in Warners headquators to tighten up on copyright infringement (by taking off YouTube videos, sueing fan sites, God knows what eles). Most likely partly driven by the financial cires, but even if it is, Warner still have the right. It does seem cruel to jump up on people like this, but it still doesn't rule off the fact that Warner can.

 

i wonder how come bazinga! is still open......

There using linkin-park.it as an example, I'm guessing that Warner is doing this to scare other sites such as bazinga!, why Warner chose linkin-park.it over another site I have no idea but thats the law.

 

I wish the people at linkin-park.it the best though, cause it was a decent site, even though it was in italien I still visited it quite a lot.

Only Demos, Bootlegs, "Other songs" and stuff like that.

 

I think warner warned him, he deleted the download zone but warner did their raid too :(

 

Edit: JomJom told me that 2-3 months before the warner raid, he was warned to remove some stuff from the DL zone. So he decided to close the whole section.

 

months after, the site will be closed by warner with no possibility to renew the internet domain

I visited linkin-park.it couple times, but I don't remember there was not legal files or not... If not - I don't understand. So the fans' live recordings, live cds, proshot videos are not legal too? BULLSHIT! Hope they won't close any Lithuanian Linkin Park site...

ya that's pretty strange. When i went to the police, they told me "you've been sued for having shared copyrighted mp3s", so i told 'em i didnt have any download area since May, and no copyrighted mp3s were on my site. They just refused to give any further explanation and so i asked "which mp3s??," They just told me "we cant say anything." I couldnt do anything at all.
